1. Master Rights Retention (100% Artist Ownership)
DIGITAL GAANA DISTRIBUTION LLP operates exclusively as a technical ingestion and digital distribution service provider. By utilizing our platform and services, the Artist / Record Label maintains 100% exclusive copyright and ownership of all sound recordings (Masters), compositions, lyrical assets, artwork, and associated intellectual property. You do not assign or transfer your copyright to us.
2. Distribution Scope & Takedown Rights
You grant DIGITAL GAANA DISTRIBUTION LLP a non-exclusive license to ingest, encode, deliver, and administer your audio and metadata to 150+ digital streaming platforms (DSPs), social networks, and telecom CRBT networks. You retain the full right to issue a takedown request for any track or entire catalog at any time by giving written notice. Takedown requests are processed within 5 to 10 business days.
3. Royalty Accounting & Payouts
Royalties received from digital streaming platforms and telecom operators are credited to your account according to agreed transparent splits. Monthly earnings reports are updated upon receipt of financial statements from DSPs. Payouts are transferred directly via Indian banking channels (NEFT / RTGS) or UPI upon reaching the minimum withdrawal threshold.
4. YouTube Content ID & CMS Policies
When enrolling tracks into our YouTube CMS / Content ID acoustic fingerprint database, you confirm and warrant that you hold exclusive master sound recording rights without third-party unlicensed samples, karaoke recordings, public domain stems, or ambient noise loops. Unauthorized attempts to claim content not owned by the uploader will result in immediate termination.
5. Anti-Fraud & Artificial Streaming Policy
DIGITAL GAANA DISTRIBUTION LLP enforces a zero-tolerance policy against artificial streaming, automated bot plays, click farms, and illegitimate stream manipulation. Streaming stores employ advanced fraud detection algorithms. Releases found utilizing artificial stream generators will be removed immediately, and generated royalties will be subject to store clawbacks and permanent account forfeiture.
6. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal disputes arising in connection with the services provided by DIGITAL GAANA DISTRIBUTION LLP (LLPIN: ACO-5385) shall be subject to the exclusive jurisdiction of the competent courts in Thane / Mumbai, Maharashtra, India.
